1. Who we are and what these Terms cover
Behavioural Health Pty Ltd (trading as Katalis Health) (“Katalis”, “we”, “us”, or “our”) provides access to our digital wellbeing education and support experiences through our website located at https://www.katalis.health (the “Site”) and any related applications, features, content, tools, and services we make available from time to time (collectively, the “Service”).
These Terms of Service (“Terms”) govern your access to and use of the Service. By accessing, browsing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not accept these Terms, you must not access or use the Service.
2. Changes to these Terms
We may change or modify these Terms at any time in our sole discretion. If we do, we will post the updated Terms on the Site and update the “Last updated” date.
Where required by applicable law, we will provide notice of material changes through the Service interface, by email, or by other reasonable means.
Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
3. Not for emergencies; crisis support
DO NOT USE THIS SERVICE FOR EMERGENCY MEDICAL OR MENTAL HEALTH NEEDS. If you are experiencing an emergency, call the emergency number in your country immediately.

4. The Service is informational and educational only
The Service is designed to provide general well-being information, education, skills practice, and resource navigation. The Service may include AI-enabled features that generate responses, suggestions, or educational guidance.
Katalis does not provide medical, psychological, psychiatric, legal, HR, financial, or other professional advice or services through the Service. The Service is not a substitute for professional advice, diagnosis, treatment, or crisis support.

5. AI features and AI personas (terms of use)
The Service may include AI-enabled features, including AI personas intended for different audiences (collectively, “AI Features”). AI Features are available only within logged-in programs and may vary depending on the program you purchase. For example, a clinician may also purchase an individual-focused program and access the AI persona associated with that program.
5.1 Intended use
AI Features are provided for general education, skills practice, reflection prompts, and resource navigation.
5.2 Not professional advice; no supervision; no emergency use
AI Features are not medical, psychological, psychiatric, legal, HR, financial, or other professional advice.
Without limiting the above:

The Service and all content made available by Katalis (excluding User Content) (“Service Content”) are owned by or licensed to Katalis and are protected by intellectual property laws.
Except as expressly permitted by these Terms, you must not copy, modify, distribute, sell, lease, or create derivative works from the Service or Service Content.
12. Paid subscriptions, bookings, and refunds
Some parts of the Service may be offered on a paid subscription basis or as paid events (including live workshops and coaching groups).
12.1 Pricing and payments
Prices, inclusions, and billing frequency (where applicable) will be shown at the point of purchase. You authorise us (and our payment processors) to charge the applicable fees and taxes.
12.2 Live workshops — cancellation and refunds
Unless required otherwise by applicable law: - No refunds will be provided for live workshops cancelled within 30 days of the scheduled event date.
12.3 Coaching groups — cancellation and refunds
Unless required otherwise by applicable law: - No refunds will be provided for coaching groups once purchased.
12.4 Consumer guarantees
Nothing in these Terms is intended to exclude, restrict, or modify any rights you have under the Australian Consumer Law or other applicable consumer protection laws that cannot be excluded.
13. Third-party services and links
The Service may include links to, or integrations with, third-party services or websites. We do not control and are not responsible for third-party services, including their content, availability, or privacy practices.
Your use of third-party services is at your own risk and may be subject to additional terms.
14. Modifications to the Service
We may modify, suspend, or discontinue the Service (in whole or in part) at any time, temporarily or permanently, with or without notice.
To the maximum extent permitted by law, Katalis will not be liable for any modification, suspension, or discontinuance of the Service.

We may suspend or terminate your access to the Service at any time if we reasonably believe:

We do not warrant that the Service will be uninterrupted, secure, error-free, or that any outputs (including AI-generated outputs) will be accurate, reliable, or suitable for your needs.

To the maximum extent permitted by law:

These Terms are intended to operate in Australia and are governed by the laws of Australia, with mandatory consumer protections applying as required.
If you access the Service from outside Australia, you are responsible for complying with local laws.

If any provision is held invalid or unenforceable, the remaining provisions will remain in effect.
You may not assign these Terms without our prior written consent. We may assign these Terms as part of a corporate restructure, sale, or transfer of the Service.
